GENTIVE’S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GENTIVE FOR THE SERVICE IN THE ONE (1) MONTH PERIOD PRECEDING THE CLAIM (E.G., $3.99).

AI may continuously generate unpredictable content. The Company constitutes no liability for hallucinations or offensive content generated by the AI model. This service is intended for users aged 14 and above.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GENTIVE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Digital Goods

Since this is a digital product involving immediate API costs and server resources upon generation, all sales are final.

Exception

Refunds may be issued at the Company’s sole discretion only in cases where the Service failed to generate an output due to technical errors explicitly attributable to the Service Provider.

3.1 Information We Collect

To provide our Service, we authenticate users via Google OAuth (facilitated by Clerk). During this process, we access and store the following Google user data:

• Primary Account Email: Used for unique account identification, login authentication, and sending service-related notifications.
• Personal Information (Name & Profile Picture): Used solely to personalize the user interface and dashboard experience.
• User Inputs: Text inputs provided by you for AI generation are processed transiently and are not permanently stored after the session.

3.2 How We Use Your Data

We use the information we collect for the following specific purposes:

• Authentication: To verify your identity and maintain secure login sessions.
• Service Delivery: To generate AI-based analysis and content as requested by you.
• Communication: To send transaction receipts or critical service updates.

We do NOT sell, rent, or trade your Google User Data to third parties for advertising purposes.

3.4 Data Sharing with Service Providers

We share necessary data with trusted third-party service providers to operate the Service:

• Clerk: For secure authentication and user management.
• Polar.sh: Acting as the Merchant of Record for payment processing.
• DeepSeek API: To process inputs and generate content. Your input data is sent to their servers under strict enterprise privacy standards and is NOT used to train their models.

Ownership

The Service, including its algorithms, code, and design, is the property of Gentive.

User Content License

You retain ownership of the output generated by your inputs. Gentive grants you a perpetual, non-exclusive, worldwide license to share, post, and display the generated content for personal and non-commercial purposes (e.g., social media sharing).

Misuse & Termination

You agree not to misuse the Service. Prohibited actions include: (a) using automated systems (bots, scrapers) to access the Service; (b) attempting to reverse engineer the code; (c) using the Service to generate illegal, hateful, or harmful content; or (d) sharing your account credentials with others.

Termination Rights

We reserve the right to suspend or terminate your access immediately, without prior notice or refund, if you violate these Terms or engage in behavior that harms the Service or other users.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising out of or in connection with this Service shall be submitted to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.
